Terms of Service

The agreement

By creating an account or using PhotoPortal, you agree to these terms. If you do not agree, do not use the service. If you are using PhotoPortal on behalf of a business, you confirm you are authorised to accept these terms for it.

You must be at least 18 years old to hold a PhotoPortal account.

Accounts

You are responsible for keeping your login credentials secure and for everything that happens under your account. Tell us promptly if you believe someone else has gained access to it.

Provide accurate information and keep it current. Photographers in particular: your storefront represents a real business to real clients, and it must not misrepresent your services, pricing or credentials.

Our role — technology provider, not the studio

PhotoPortal provides software. Photographers use it to run their own independent businesses.

That means disputes about a session — its quality, timing, cancellation or refund — are between the photographer and the client, under whatever contract they agreed in the app. We provide the tools that record it, and we will provide records where we reasonably can.

Payments and fees

Payments are processed by Stripe. Photographers connect their own Stripe account, and client payments are settled directly into it. Your use of Stripe is additionally governed by the Stripe Connected Account Agreement.

• Platform fee. We take a percentage of each transaction processed through the platform. The current rate is shown in the app before you connect payouts, and on each transaction in your financial records.
• Tips are not subject to the platform fee. A tip goes to the photographer in full.
• Pricing is set by the photographer. Amounts are calculated by our servers from the packages, add-ons, discounts and deposit rules the photographer configured — never sent by the app.
• Refunds are issued by the photographer through the app, according to the cancellation terms in their contract. The platform fee on a refunded payment is not returned. Chargebacks are handled through Stripe’s dispute process.
• Taxes are the photographer’s responsibility. Charges are made on their behalf and the tax liability sits with their business.

Your content

You keep ownership of your photographs. Uploading them to PhotoPortal does not transfer any ownership to us.

You grant us a limited, non-exclusive licence to store, process, resize and display your content strictly for the purpose of operating the service — generating thumbnails and previews, delivering galleries to the client they belong to, and rendering the storefront you chose to publish. That licence ends when you delete the content or your account, subject to the retention periods in our Privacy Policy.

We do not use your photographs for marketing without your explicit, separate permission.

You are responsible for holding the rights and permissions to everything you upload, including model releases and, where a session involves children, the consent of a parent or guardian.

Acceptable use

Do not use PhotoPortal to:

• Upload content you do not have the right to upload.
• Upload unlawful content, or any sexual content involving minors.
• Harass, threaten, or impersonate anyone.
• Attempt to access another user’s account, bookings, galleries or financial records.
• Probe, scrape, overload, or interfere with the service or its infrastructure.
• Misrepresent your identity, business, or the services you provide.

The app includes reporting and blocking tools. We may remove content and suspend or terminate accounts that breach these rules.

Availability

We work to keep PhotoPortal available and reliable, but we do not guarantee uninterrupted service. Features may change, and we may add, alter or withdraw functionality over time.

Keep your own copies of your photographs. PhotoPortal is a delivery and business tool, not an archival backup service, and you should not rely on it as the only copy of your work.

Ending your account

You can delete your account at any time from within the app, or through our data deletion page. Deletion is permanent. What is removed and what is retained in anonymised form is set out in the Privacy Policy.

We may suspend or terminate an account that breaches these terms, or where we are required to by law. Where it is reasonable to do so, we will give notice first and allow delivered galleries to be downloaded.

End User License Agreement (mobile app)

This End User License Agreement is a binding agreement between you and the developer of PhotoPortal governing your use of the PhotoPortal mobile application. By downloading, installing or using the application, you agree to it.

1. Acknowledgment

This Agreement is concluded solely between you and the Developer, and not with Apple Inc. (“Apple”). The Developer, not Apple, is solely responsible for the application and its content. The terms of this Agreement do not conflict with the Apple Media Services Terms and Conditions.

2. Scope of licence

The Developer grants you a limited, non-exclusive, non-transferable, revocable licence to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the application may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.

3. Maintenance and support

The Developer is solely responsible for providing maintenance and support. You acknowledge that Apple has no obligation to furnish any maintenance or support services for the application.

4. Warranty

The Developer is solely responsible for any product warranties, express or implied, to the extent not effectively disclaimed. If the application fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the Developer’s sole responsibility.

5. Product claims

The Developer, not Apple, is responsible for addressing any claims by you or a third party relating to the application or your use of it, including product liability claims, claims that the application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

6. Intellectual property rights

In the event of a third-party claim that the application or your use of it infringes that party’s intellectual property rights, the Developer, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.

7. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-party beneficiary

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement, and that Apple has the right to enforce it against you.

Liability

To the maximum extent permitted by law, PhotoPortal is provided “as is” without warranties of any kind. We are not liable for indirect, incidental or consequential losses, or for lost profits, lost bookings, or lost data.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page and, for material changes, notify you in the app. Continuing to use PhotoPortal after a change means you accept the updated terms.
